This claim that the frozen embryos should be considered children according to Texas law has been thrown out repeatedly by Texas courts. It’s almost certainly not going anywhere.

Her request was denied, but she appealed, arguing that because the new law defines an unborn child as human “from fertilization until birth, including the entire embryonic and fetal stages of development,” her and her husband’s embryos are considered people under Texas law.

I don’t see how frozen embryos aren’t “unborn children” given the way the law is written.

It’s stupid as fuck but that’s what it says.

If this does get thrown out can’t that be used later to show Texas wasn’t actually serious about the definition and abortions may now go forward?

How could Texas have it both ways?

Because Texas is a fascist state and gives not a shit for consistency. The governer just pardoned a murderer because he killed a BLM protestor. The sate only enforces the law against those they don’t like, and give their christian nationalists a hard pass.
